Information on data processing

1.Name and contact details of the controller and the company data protection officer

This privacy policy applies to the website of KUMETA Kunststoff- und Metallaufbereitungs-GmbH and the personal data collected via this website. For websites of other providers that are referred to via links, for example, the privacy policies and declarations applicable there apply.

2. Data collection and logging on this website

You can usually use our website without providing any personal information. Where personal information (such as your name, address or email address) is collected on our website, this is always done on a voluntary basis as far as possible. This information will not be passed on to third parties without your express consent. We would like to point out that data transmission over the Internet (e.g. when communicating by e-mail) can have security gaps. Complete protection of data against access by third parties is not possible. We hereby expressly object to the use of contact data published within the scope of the imprint obligation by third parties for sending unsolicited advertising and information materials. The operators of the pages expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, for example through spam emails.

When you access our online offering, you transmit data to our web server via your internet browser. This is a technically necessary process.

On the basis of our legitimate interests within the meaning of Art. 6(1)(f) GDPR, we collect data about every access to the server on which this service is located (so-called server log files). The access data includes

  • Date and time of the request
  • Name of the requested file
  • Page from which the file was requested
  • Access status (file transferred, file not found, etc.)
  • Web browser and operating system used
  • Full IP address of the requesting computer
  • The requesting provider
  • Amount of data transferred

Log file information is stored for security reasons (e.g. to investigate misuse or fraud) for a maximum period of seven days and then deleted. Data that must be retained for evidentiary purposes is excluded from deletion until the respective incident has been finally clarified.

2.1 Cookies 

This website uses its own cookies to improve user-friendliness (cookies are data records sent by the web server to the user’s browser and stored there for later retrieval). No personal data is stored in our own cookies.

If you do not want cookies to be stored on your computer, you can deactivate the corresponding option in your browser’s system settings. Stored cookies can be deleted in the browser’s system settings. Excluding cookies may lead to functional restrictions of this online offer.

2.2 Integration of third-party services and content

Social plugins from YouTube 

We use social plugins from the Google-operated site YouTube. This site is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit our site equipped with a YouTube plugin, a connection to the YouTube servers is established. This informs the YouTube server that you have visited our site.

If you are logged into your YouTube account, you enable YouTube to associate your visit to our site with your user account. You can prevent this by logging out of your YouTube account.

3. Collection and storage of personal data, as well as the nature, purpose and use thereof

If you are a customer, supplier or contractual partner of Zirec, we collect the following information:

  • Title, first name, surname, if applicable, also of other contact persons in your company
  • Email address,
  • Postal address
  • Telephone number (landline and/or mobile)
  • Tax numbers, VAT identification numbers
  • Bank details
  • Information necessary for the performance of the respective contractual relationship

This data is collected,

  • to identify you as our contractual partner;
  • to advise you appropriately and/or to fulfil the existing contractual relationship or to carry out pre-contractual measures;
  • to correspond with you;
  • for invoicing;
  • to process any liability claims that may exist and to assert any claims against you;

Data processing is carried out at your request and is necessary for the purposes specified in Art. 6(1)(b) GDPR for the processing and mutual fulfilment of obligations arising from the contract. We process the data that we have received from you in the course of our business relationship.

The personal data collected by us for business relationships is stored until the expiry of the statutory retention period (usually 10 years) and then deleted, unless we are obliged to store it for a longer period in accordance with Article 6(1)(c) of the GDPR due to tax and commercial law retention and documentation obligations (from the German Commercial Code, Criminal Code or Fiscal Code) or you have consented to further storage in accordance with Article 6(1)(a) GDPR.

4. Transfer of data to third parties, no data transfer to non-EU countries

As a matter of principle, we only use your personal data within our company.

If and to the extent that we engage third parties in the fulfilment of contracts (e.g. logistics service providers), they only receive personal data to the extent that the transfer is necessary for the corresponding service.

In the event that we outsource certain parts of data processing (‘contract processing’), we contractually oblige processors to use personal data only in accordance with the requirements of data protection laws and to ensure the protection of the rights of the data subject.

Data is not transferred to entities or persons outside the EU and there are no plans to do so.

The rights of public authorities in justified cases (e.g. tax authorities) remain unaffected.

5. Rights of data subjects

You have the right:

  • pursuant to Art. 7(3) GDPR, to revoke your consent at any time. As a result, we will no longer be permitted to continue processing data based on this consent in the future;
  • pursuant to Art. 15 GDPR, to request information about your personal data processed by us. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if it was not collected by us, and the existence of automated decision-making, including profiling and, if applicable, meaningful information about its details;
  • to request the immediate rectification of inaccurate or incomplete personal data stored by us in accordance with Art. 16 GDPR;
  • pursuant to Art. 17 GDPR, to request the erasure of your personal data stored by us, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;
  • pursuant to Art. 18 GDPR, to request the restriction of the processing of your personal data, unless the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to have it deleted and we no longer need the data, but you need it to assert, exercise or defend legal claims, or you have lodged an objection to the processing pursuant to Art. 21 GDPR;
  • pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request its transfer to another controller; and
  • pursuant to Art. 77 GDPR, to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters for this purpose.

6. Right of objection

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6(1)(f) GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are reasons for this arising from your particular situation.
